Partner Terms

These terms govern the partner programme of AgrarDesk. They apply between René-Uwe Zschieschang, Rua Cidade de João Belo 9, 2 ESQ, 1800-086 Lisboa, Portugal (hereinafter "AgrarDesk") and you as a partner. The Terms and Conditions of agrardesk.com apply in addition.

1. Admission

You become a partner when AgrarDesk expressly admits you to the partner programme. There is no right to be admitted. Your personal conditions and benefits are always shown in your partner area at agrardesk.com/partner.

You need to accept these terms in your partner area before any payout.

2. Your referral link and attribution

  • You receive one or more referral links with a personal code.
  • If someone opens your link and signs up for a new account in the same browser within 30 days, the new account is attributed to you. If another partner link was opened before, that one applies.
  • An account can only be attributed to one partner. The attribution stays in place.
  • Accounts that have already paid AgrarDesk, your own accounts and accounts with your contact address are not attributed.
  • Clicks on your link are counted without personal data. The number is a rough guide.

3. Commission

  • You receive the percentage stated in your partner area on every payment made by an account attributed to you.
  • The basis is the amount actually paid, excluding VAT. If a voucher or discount is used, the reduced amount counts.
  • Commission applies to payments within the period stated in your partner area, counted from the account's first payment.
  • There is no commission on settlement payments after a chargeback, on payments while a chargeback on the account is open, or on payments in a currency other than euro.
  • Your partner area shows every booking with date, amount and status.

4. Hold period, refunds and chargebacks

  • A commission becomes payable only after the hold period stated in your partner area, counted from the payment.
  • If a payment is refunded or charged back in full or in part, the commission for it is reversed proportionally.
  • If the commission was already paid out, the reversal is offset against your next payouts.

5. Payout and credit note

  • Payouts happen once a month as soon as the payable commission reaches the minimum amount stated in your partner area. If the partnership ends, the remainder is paid out after the hold periods, even below that amount.
  • Payouts are made by SEPA transfer or PayPal to the details you enter in your partner area.
  • For a payout we need your full legal name, your address, your country, your tax status and your tax number. If details are missing, the commission stays on hold and is paid out once they are complete.
  • For every payout AgrarDesk issues a credit note and sends it to you by email. By accepting these terms you agree to this self-billing procedure. The credit note does not show VAT.
  • You are responsible for your details being correct and take care of the taxation of your income yourself. If something on a credit note is wrong, please let us know straight away at info@agrardesk.com.

6. Advertising and conduct

  • You label posts containing your referral link as advertising, as required by applicable law and the rules of the respective platform.
  • You make no false or misleading statements about AgrarDesk, for example about prices, features or gifts.
  • No spam, no bought or automated clicks and no sign ups through secondary accounts.
  • You use the AgrarDesk name and logo only to promote AgrarDesk.

7. Benefits

  • AgrarDesk may put your own account on a plan free of charge while the partnership lasts. If this benefit is switched off or the partnership ends, it continues for another 30 days.
  • AgrarDesk may decide that new accounts coming through your link get a plan for a set time for free. This applies once per account, not to accounts that have already paid, and only in limited numbers per day.
  • AgrarDesk decides whether and to what extent these benefits apply. They may be changed or ended. What currently applies is shown in your partner area.

8. Term and end

  • The partnership runs for an indefinite period. Either side can end it at any time, a message to info@agrardesk.com is enough.
  • When it ends, your referral links are deactivated. For accounts attributed to you until then, you keep receiving commission until the end of their commission period.
  • If you seriously breach these terms, for example through self referral, bought sign ups or misleading advertising, AgrarDesk may end the partnership immediately and cancel the commission for the payments concerned.

9. Data protection

You do not get to see names or email addresses of the accounts that come through your link. Your partner area only shows a short code per account. AgrarDesk processes your details to run the partnership, to settle payouts and to meet statutory retention obligations, for example for credit notes. More on this in the Privacy Policy.

10. Changes to these terms

AgrarDesk may change these terms. A new version is shown to you in your partner area and must be accepted before the next payout. Commission keeps being booked in the meantime. The version in force is publicly available together with its date.

11. Final provisions

The law at the registered seat of AgrarDesk applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the country in which a partner acting as a consumer has their habitual residence remain unaffected.

Should individual provisions of these terms be or become invalid, the validity of the remaining provisions remains unaffected.
